Today enters into force the Electronic Commerce Law, which aims to regulate the legal framework of electronic relations of commercial and contractual nature that are made by digital or electronic means, being such regulations applicable to any natural or legal person established in El Salvador.
This new law responds to the imperative need to streamline trade between people who use technological platforms to carry out transactions that will now be simplified since it is undeniable that in recent years information and communication technologies have evolved the way of doing business between traders and users, being necessary the creation of a legal framework that is able to provide legal certainty and confidence to all those who make use of these new technologies.
Among the main aspects contemplated by this law, we can mention, by way of example, the following::

  • All those suppliers of goods and services who wish to send notices with advertising of any kind, or promotions without the prior consent of the user, may only do so if they expressly indicate that the communication sent is unsolicited, in addition to other requirements to be met for the sending of these advertisements by the suppliers.
  • The service providers that carry out electronic contracting activities, shall be obliged to make available to the users the complete information of the goods or services they are contracting, making it available permanently, easily and free of charge.
  • The electronic invoice issued by the suppliers of the goods or services to those persons who are users of electronic commerce, will have the same accounting and tax validity as the conventional invoice.
  • The supplier of the goods or services is obliged to confirm the receipt of the acceptance by sending an acknowledgement of receipt via e-mail and any other electronic means of communication that has been indicated by the user. Suppliers are obliged to have a mechanism for receiving and managing complaints permanently, easily and free of charge.
