This March 24, 2020, the National Assembly of the Republic of Nicaragua, approved with 70 votes in favor, the reform to Law 380 Law of Trademarks and Other Distinctive Signs Law of Trademarks and Other Distinctive Signs, with which it is intended to provide a better service to users as well as filling gaps and contradictions found in Law 380.

Among the most important elements resulting from the reform are the simplification of deadlines, with which it is intended to achieve the speed desired by the users of the Intellectual Property Registry, the reduction of the times to answer oppositions and/or objections , establishing for the counting of the same business days and the declarative status of the Trade Name is maintained.

The reform, in the same way, comes to give value to the work carried out by the Intellectual Property Registry, establishing benefits for small companies related to the amounts of the fees to be paid.

Regarding the value of current fees for trademark registration, these have been modified, to be in accordance with the other countries of the region, which are established as follows:

  • Basic Rate $ CA. 135.00
  • Complementary for each class $ CA. 65.00
  • Denomination of origin $ CA. 300.00
  • Trade name, emblem $ CA. 135.00
  • Expression or sign of commercial advertising $ CA. 135.00
  • For renewal of a trademark registration: – For each $CA class. 135.00
  • Complementary Renewal for each class $CA. 135.00
  • Grace period renewal fee: $CA. 65.00 additional per class
  • Division of a trademark registration application $CA. 50.00 for each fractional request
  • Cancellation or Limitation $CA. 50.00
  • Modifications Change of Address, Transfer, License of Use, Mergers, etc. $CA. 60.00
  • Voluntary Cancellation or Limitation $CA. 60.00
  • Certifications and Duplicate Certificate $CA. 25.00 +$CA. 10 additional for each complementary class.
  • For corrections and modifications of requests in process $ CA 60.00
  • By search of registry antecedents by trademarks: Denominative in each class $CA. 25.00
  • By search of registry antecedents by brands: Headline and Figurative Elements in each class $CA. 50.00
  • By search of registry antecedents by sound, olfactory mark in each $CA class. 50.00
  • By search of registry antecedents for mixed brands in each $CA class. 50.00
  • Extension of Deadlines $CA. 25.00
  • Notice Reset $CA. 25.00
  • Presentation of Opposition $CA. 50.00
  • Informal Management $CA. 20.00
  • Registration or Update of Powers $CA. 25.00
  • For each application form $CA. 2.00
  • For each Simple Photocopy of the Documents contained in the $CA Registry. 1.00

This reform to Law 380 and its regulations will enter into force when so indicated by the National Assembly or when it is published in La Gaceta, Official Gazette.
